These Terms of Service apply to your access to and use of KennelOS.

These Terms of Service apply to your access to and use of KennelOS.
KennelOS is a software service operated by Nelson Ngo, ABN 68 264 322 144 ("KennelOS", "we", "us" or "our").
By creating an account, accepting these Terms or using KennelOS, you agree to these Terms. If you do not agree, do not use the service.
1. What KennelOS provides
KennelOS is breeder management software designed to help dog breeders organise information and workflows relating to:
- breeder profiles
- dogs
- matings
- litters
- puppies
- photos
- health and weight records
- genetics
- waitlists
- buyer details
- reservations and placements
- breeder-recorded payments
- handover preparation
- compliance records
- income and expenses
- data exports
KennelOS may add, remove or change features over time. We will take reasonable steps to avoid changes that materially disadvantage active users without notice.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to create a breeder account.
You must provide accurate account information and keep it reasonably current.
You must not create an account for another person or business unless you have authority to act for them.
3. Accounts and security
You are responsible for:
- protecting your login credentials
- using a secure password
- keeping your email address current
- controlling access to devices used to access KennelOS
- notifying us promptly if you suspect unauthorised access
You must not share an account in a way that defeats access controls or allows an unauthorised person to access breeder, buyer or animal records.
We may require account verification, password reset or additional security steps where reasonably necessary to protect users or data.
5. Your information and content
You retain your rights in the information and content you upload or create in KennelOS.
You give KennelOS a limited, non-exclusive licence to host, store, process, reproduce and display that content only as reasonably necessary to:
- provide the service
- secure and maintain the service
- create exports requested by you
- comply with lawful obligations
- investigate misuse or security incidents
- support features you choose to use
You are responsible for ensuring that:
- information you enter is accurate to the extent reasonably possible
- you have authority to upload personal information about buyers and other individuals
- you give individuals any notices required by law
- your use of KennelOS complies with applicable laws, council rules, registry rules and organisation requirements
- you do not upload more personal information than is reasonably needed
Do not upload passwords, payment card numbers, government identity documents or unrelated sensitive personal information unless KennelOS explicitly provides a secure field for that purpose.
6. Buyer information
Breeders may store information about prospective or actual buyers, including contact details, preferences, payment records and placement information.
You must have a reasonable basis for collecting and entering buyer information.
Where required, you must tell the buyer:
- that their information is being entered into KennelOS
- why it is being collected
- who may access it
- how they can request access or correction
- where they can read the KennelOS Privacy Policy
KennelOS may provide collection-notice templates, but you remain responsible for confirming that your notices and practices are suitable for your circumstances.
7. Animal records and health information
KennelOS may store animal health, vaccination, worming, medication, genetics and weight information.
KennelOS does not verify the accuracy or completeness of user-entered animal records.
KennelOS is not a veterinary service and does not provide veterinary advice.
You should seek advice from a qualified veterinarian for animal health decisions.
8. Compliance guidance
KennelOS may provide compliance checklists, source links, due-date guidance and organisational prompts.
This material:
- is intended to help organise breeder records
- may be limited by state, territory, council, registry or breeder organisation
- may not reflect every rule that applies to you
- may change when official sources change
- is not legal advice
- does not guarantee compliance
Victoria may receive deeper guided coverage than other jurisdictions at some stages of product development.
You remain responsible for confirming the requirements that apply to your breeding activities.
9. Financial records
KennelOS may allow you to record deposits, final payments, puppy-sale income and expenses.
KennelOS does not process payments unless a future feature expressly says otherwise.
KennelOS is not accounting, tax or financial advice.
You are responsible for your invoices, receipts, taxes, GST obligations and financial record keeping.
10. Beta service
Where KennelOS is offered as a beta service:
- features may be incomplete
- errors may occur
- data structures and workflows may change
- some features may be removed
- access may be limited to selected testers
- support may be limited
- no service-level agreement applies unless we agree otherwise in writing
The Closed Beta Terms in this pack form part of these Terms during the beta period.
A beta label does not remove rights that cannot lawfully be excluded.
11. Availability and maintenance
We aim to provide a reliable service, but we do not promise uninterrupted availability.
The service may be unavailable because of:
- maintenance
- third-party provider outages
- security incidents
- internet or network failure
- emergency changes
- events outside our reasonable control
Where reasonably practicable, we will communicate material planned interruptions.
12. Backups and recovery
We use technical and organisational measures intended to reduce the risk of data loss.
No online service can promise that data loss will never occur.
You should keep copies of records that are critical to your legal, tax, breeding or animal-care obligations.
Where an export feature is available, we encourage you to export important records periodically.
13. Third-party services
KennelOS relies on third-party services for functions such as hosting, database storage, authentication, file storage, monitoring and communications.
Your use of some features may also be subject to third-party terms.
We are not responsible for third-party services outside our reasonable control, but we will take reasonable steps in selecting and managing providers.
14. Intellectual property
KennelOS and its software, branding, interfaces, documentation and original content are owned by us or our licensors.
These Terms do not transfer ownership of KennelOS intellectual property to you.
We grant you a limited, non-exclusive, non-transferable right to use KennelOS during your authorised account access.
You must not use KennelOS branding in a way that suggests endorsement, partnership or government approval without written permission.
15. Feedback
You may provide feedback, ideas or suggestions.
You give us permission to use feedback to improve KennelOS without payment or obligation, provided we do not identify you publicly without permission.
Do not include confidential personal information in feedback reports unless necessary to investigate a problem.
16. Suspension
We may temporarily restrict or suspend access where reasonably necessary to:
- protect users or data
- investigate suspected unauthorised access
- respond to a security incident
- prevent unlawful use
- address a serious breach of these Terms
- comply with a legal requirement
- protect service stability
Where appropriate, we will give notice and a reasonable opportunity to respond.
Immediate action may be required where delay would create a material security, legal or safety risk.
17. Ending your account
You may stop using KennelOS at any time.
You may request account closure through the process described in the service.
Before closing your account, you should export records you need to retain.
Account closure and deletion may not result in immediate removal from:
- active systems
- backups
- audit logs
- records we must retain by law
- records required to resolve a dispute or security issue

18. Our right to end service access
We may end or decline to renew access where:
- you materially breach these Terms
- your use creates a material security or legal risk
- continued provision is unlawful
- the service is discontinued
Except where immediate action is reasonably necessary, we will aim to give reasonable notice and an opportunity to export your data.
19. Consumer guarantees
Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
Where services are covered by statutory consumer guarantees, those guarantees apply.
20. Disclaimers
To the maximum extent permitted by law:
- KennelOS is provided as a software tool
- user-entered information remains the user's responsibility
- compliance guidance is organisational guidance only
- KennelOS does not provide legal, veterinary, accounting, tax or financial advice
- KennelOS is not a party to a puppy sale between breeder and buyer unless expressly agreed in writing
- official sources and qualified advisers should be used for professional decisions
This clause does not exclude rights that cannot lawfully be excluded.
21. Liability
This section requires lawyer review before publication.
To the maximum extent permitted by law, KennelOS is not liable for indirect or consequential loss arising from use of the service, including lost profits, lost opportunity or reputational loss.
Where liability cannot be excluded but can lawfully be limited, liability may be limited to an appropriate remedy permitted by law, such as re-supplying the service or paying the reasonable cost of re-supply.
Any final liability cap must be reviewed for fairness and compliance with the Australian Consumer Law.
Do not publish a fixed liability cap until the operator structure, pricing and insurance position are known.
22. Indemnity
This section requires lawyer review before publication.
You are responsible for loss reasonably arising from your unlawful use of KennelOS, your infringement of another person's rights or your unauthorised upload of personal information.
Any indemnity must be limited to loss caused by the user's conduct and must not attempt to transfer risks that should reasonably remain with KennelOS.
23. Changes to these Terms
We may update these Terms where reasonably necessary because of:
- legal or regulatory changes
- security requirements
- product changes
- provider changes
- business changes
For material changes, we will provide reasonable notice through the service or by email where practicable.
If a change materially affects your rights, it will take effect prospectively unless the law requires otherwise.

We will try to resolve concerns fairly and promptly.
These Terms are governed by the laws of Victoria, Australia, Australia.
The courts of that jurisdiction have non-exclusive jurisdiction, subject to any rights you have to bring a claim elsewhere under applicable law.
